Returns
You have 30 days to return your order (withdrawal from a distance contract). The period starts from the date you receive the last item that was part of your order.
Refunds will be processed in accordance with applicable law, no later than 14 days from the date we receive the returned products. However, the process is usually quicker. Depending on the payment method you chose, you will receive the refund through the same method. If you paid by cash on delivery or bank transfer, the refund will be made to the bank account specified by you in the Return Form.
IMPORTANT
The consumer is responsible for any reduction in the value of the goods resulting from handling them in a way that goes beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

Right of Withdrawal
A customer who is a consumer has the right to withdraw from the sales contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which the customer or a third party, other than the carrier and indicated by the customer, acquires physical possession of the product.
A consumer is also understood as a natural person concluding a contract directly related to their business activity, where the content of this contract indicates that it does not have a professional character for this person, arising particularly from the subject of their business activity, as made available based on the regulations of the Central Register and Information on Economic Activity.
To exercise the right of withdrawal, you must inform us of your decision to withdraw from the sales contract by a clear statement sent to us by mail or electronically to [email protected].
You may use the withdrawal form template, which is an attachment to our online store’s Terms and Conditions. However, using the form is not mandatory.
To meet the withdrawal deadline, it is sufficient for the customer to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Please note that the right to withdraw from a distance contract does not apply to contracts specified in Article 38 of the Act of May 30, 2014, on consumer rights, including contracts where the subject of the service is a non-prefabricated item produced according to the consumer’s specifications or serving to satisfy their individualized needs.
Consequences of Withdrawal
In the event of withdrawal from this contract, we will refund all payments received from you, including the cost of delivery of the items (except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by our online store), without undue delay and, in any event, not later than 14 days from the day on which we are informed about your decision to exercise the right to withdraw from this contract. We will carry out the refund using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of this refund.
We may withhold the refund until we have received the product back or you have supplied evidence of having sent back the product, whichever is the earliest.
Please send back the product to the following address: PROGRESS Sports & Entertainment, ul. Malinowa 40, 97-330 Barkowice, without undue delay and in any event no later than 14 days from the day you informed us about your withdrawal from this contract. The deadline is met if you send back the product before the period of 14 days has expired. Please note that you will bear the direct cost of returning the product.
Liability for Product Compliance with the Contract
In accordance with Articles 43a and subsequent articles of the Act of May 30, 2014, on consumer rights, the seller is responsible to the customer who is a consumer for the compliance of the product with the sales contract. A consumer is also understood as a natural person concluding a contract directly related to their business activity, where the content of this contract indicates that it does not have a professional character for this person, arising particularly from the subject of their business activity, as made available based on the regulations of the Central Register and Information on Economic Activity.
The seller is not liable for the lack of product compliance with the contract in the scope mentioned in Article 43a paragraphs 2 or 3 of the Act of May 30, 2014, on consumer rights if the consumer was explicitly informed at the latest at the time of concluding the contract that a particular characteristic of the product deviates from the requirements for conformity with the contract specified in Article 43a paragraphs 2 or 3 of the Act and the consumer has explicitly and separately accepted the lack of a particular characteristic of the product.
The seller is responsible for the lack of conformity of the product with the contract that existed at the time of its delivery and manifested within two years from that time, unless the product’s useful life, as specified by the seller, their legal predecessors, or persons acting on their behalf, is longer. It is presumed that any lack of conformity that becomes apparent within two years after delivery of the product existed at the time of delivery, unless proved otherwise or this presumption is incompatible with the nature of the product or the nature of the lack of conformity.
A complaint about the non-conformity of the product with the contract should be sent electronically to [email protected] or in writing to the seller’s address. The complaint can be sent on the form provided as an attachment to our Terms and Conditions.
If the product is non-compliant with the contract, the consumer may request its repair or replacement. The seller may replace the product when the consumer requests repair or the seller may repair the product when the consumer requests replacement, if making the product conform to the contract in the way chosen by the consumer is impossible or would involve disproportionate costs for the seller. If repair and replacement are impossible or would involve disproportionate costs for the seller, the seller may refuse to bring the product into conformity with the contract.
If the product is non-compliant with the contract, the consumer may submit a statement to reduce the price or withdraw from the contract when:
- a) The seller has refused to bring the product into conformity with the contract;
- b) The seller has not brought the product into conformity with the contract;
- c) The lack of conformity of the product with the contract continues despite the seller’s attempt to bring the product into conformity with the contract;
- d) The lack of conformity of the product with the contract is so significant that it justifies an immediate reduction in price or withdrawal from the contract without first requesting repair or replacement;
- e) It is evident from the seller’s statement or the circumstances that they will not bring the product into conformity with the contract within a reasonable time or without significant inconvenience to the consumer.
The customer may not withdraw from the contract if the lack of conformity of the product with the contract is insignificant.
The seller shall return to the consumer the amounts due as a result of exercising the right to reduce the price without undue delay and no later than 14 days from the day of receipt of the consumer’s statement on the price reduction.
In the event of withdrawal from the contract, the consumer shall immediately return the product to the seller at the seller’s expense. The seller shall return the price to the consumer without undue delay and no later than 14 days from the day of receipt of the product or proof of its return. The seller shall refund the price using the same payment method used by the consumer unless the consumer expressly agrees to a different refund method, which does not involve any costs for them.
If necessary to assess physical defects, the product should be delivered to the following address: PROGRESS Sports & Entertainment, ul. Malinowa 40, 97-330 Barkowice.
The seller will respond to the customer’s complaint within 14 calendar days from the day of its receipt. Failure to address the complaint within the specified period is equivalent to accepting the complaint.
The seller shall cover the costs of collection, delivery, defect removal, or replacement of the product with a new one.
