Returns

You have 30 days to return your order (withdraw from the distance contract). Time is calculated from the date you receive the last item that is the subject of the order.

We will refund your money, in accordance with applicable law, no later than 14 days counting from the day we receive the returned products. However, usually this process is faster.

Depending on what form of payment you have chosen, you will receive a refund via the same route. If you paid for your order by cash on delivery or by traditional transfer, the refund will be made to the bank account you indicated in the Return Form.

IMPORTANT

The consumer shall be liable for any diminution in the value of the thing that is the subject of the contract, and which is the result of using it in a manner beyond what is necessary to ascertain the nature, characteristics and functioning of the thing.

Returns and complaints policy

Right of withdrawal

A customer who is a consumer has the right to withdraw from the sales contract within 14 days without giving any reason. The deadline for withdrawal from the contract expires after 14 days from the day on which the customer took possession of the item or on which a third party other than the carrier and indicated by the customer took possession of the Product.

A consumer is also understood as a natural person who enters into a contract directly related to his business activity, when it is clear from the content of the contract that it does not have a professional character for that person, arising in particular from the subject of his business activity, made available on the basis of the provisions on the Central Register and Information on Business Activity.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from the sales contract by an unequivocal statement sent to us by mail or e-mail to sklep@football-mat.com.
The customer may use the model withdrawal form attached as Appendix No. 1 to the Regulations of our online store. Use of the model form is not mandatory.

In order to comply with the withdrawal period, it is sufficient for the customer to send information on the exercise of his right of withdrawal before the end of the withdrawal period.

We would like to inform you that the right to withdraw from a contract concluded at a distance does not apply to contracts specified in Art. 38 of the Law of May 30, 2014. On consumer rights, m. in. in relation to a contract in which the subject of performance is a non-refabricated good, produced to the consumer’s specifications or serving to meet his individualized needs.

Effects of withdrawal from the contract

In the event of withdrawal from this contract, we will return to you all payments received from you, including the costs of delivery of the items (except for the additional costs resulting from the delivery method chosen by you other than the cheapest ordinary delivery method offered in our Online Store) immediately, and in any case no later than 14 days from the day on which we are informed of your decision to exercise your right to withdraw from this contract. We will refund the payment using the same means of payment used by the customer in the original transaction, unless the customer has expressly agreed otherwise; in any case, the customer will not incur any fees in connection with this refund.

Please be advised that we may withhold reimbursement until you receive the Product or until you provide us with proof of return, whichever event occurs first.

Please return the Product to: PROGRESS Sports & Entertainment, ul. Raspberry 40, 97-330 Barkowice immediately, and in any case no later than 14 days from the day on which we were informed of the withdrawal from the sales contract. The deadline is met if the Product is returned before the expiration of the 14-day period. Please be advised that the customer will be required to bear the direct costs of returning the item.

RESPONSIBILITY FOR THE CONFORMITY OF THE PRODUCT WITH THE CONTRACT
According to Art. 43a et seq. Law of May 30, 2014. On consumer rights the Seller is responsible to the Customer who is a consumer for the conformity of the Product with the contract of sale. A consumer is also understood as a natural person who enters into a contract directly related to his business activity, when it is clear from the content of the contract that it does not have a professional character for that person, arising in particular from the subject of his business activity, made available on the basis of the provisions on the Central Register and Information on Business Activity.

The Seller shall not be liable for the lack of conformity of the Product with the contract to the extent referred to in Art. 43a para. 2 or 3 of the Law of May 30, 2014. on consumer rights, if the consumer, at the latest at the time of the conclusion of the contract, has been expressly informed that a particular feature of the Product deviates from the requirements for conformity with the contract set forth in Art. 43a para. 2 or 3 of the Act and expressly and separately accepted the absence of a specific feature of the Product.

The Seller shall be liable for the Product’s non-conformity with the contract existing at the time of delivery and revealed within two years from that time, unless the Product’s shelf life, as determined by the Seller, its legal predecessors or persons acting on their behalf, is longer. The Product’s non-conformity with the contract, which became apparent before the expiration of two years after delivery of the Product, shall be presumed to have existed at the time of delivery, unless the contrary is proven or the presumption cannot be reconciled with the specifics of the Product or the nature of the Product’s non-conformity with the contract.

Notification of non-conformity of the Product with the contract should be sent by e-mail to sklep@football-mat.com or in writing to the address of the registered office of the Seller. The application can be sent on the form attached as Appendix 2 to the Regulations.

If the Product is not in conformity with the contract, the consumer may demand its repair or replacement. The Seller may make an exchange when the consumer requests a repair, or the Seller may make a repair when the consumer requests a replacement, if bringing the Product into conformity with the contract in the manner chosen by the consumer is impossible or would require excessive costs for the Seller. If repair and replacement are impossible or would require excessive costs for the Seller, he may refuse to bring the Product into conformity with the contract.

If the Product is not in conformity with the contract, the consumer may submit a statement of price reduction or withdrawal from the contract when:
a) The Seller refused to bring the Product into conformity with the contract;
(b) The Seller failed to bring the Product into conformity with the contract;
(c) the Product’s non-conformity with the contract continues even though the Seller has tried to bring the Product into conformity with the contract;
(d) the Product’s non-conformity with the contract is so significant as to justify a reduction in price or withdrawal from the contract without first taking the opportunity to repair or replace it;
(e) it is clear from the Seller’s statement or circumstances that he will not bring the Product into conformity with the contract within a reasonable time or without undue inconvenience to the consumer.
The customer may not withdraw from the contract if the lack of conformity of the Product with the contract is insignificant.

The seller shall refund to the consumer the amounts due as a result of exercising the right to reduce the price immediately, no later than 14 days from the date of receipt of the consumer’s statement on price reduction.

In the event of withdrawal from the contract, the consumer shall immediately return the Product to the Seller at his expense. The seller shall refund the price to the consumer immediately, no later than within 14 days from the date of receipt of the Product or proof of its return. The seller shall refund the price using the same method of payment used by the consumer, unless the consumer has expressly agreed to a different method of refund that does not involve any costs for him.

If necessary for the evaluation of physical defects, the Product should be delivered to the address: PROGRESS Sports & Entertainment, ul. Raspberry 40, 97-330 Barkowice.
The Seller shall respond to the Customer’s application within 14 calendar days from the date of its receipt. Failure to consider the application within the specified time limit is tantamount to acceptance.

The Seller shall cover the costs of collection, delivery, removal of defects or replacement of the Product with a new one.
